Regular Town Board Meeting of the Van Buren Town Board, held at the Van Buren Town Hall, 7575 Van Buren Road, Baldwinsville, New York on June 21, 2011 at 7:30 pm.

Approve minutes of the 6/7/11 Regular Town Board meeting:

Consider fence waiver for 105 Brassie Drive:

Mr. Sykes said the homeowner has not submitted a plan to the Board for the fence and this item will be removed from the agenda until the paperwork is received.

 

Action on request for sewer connection – Terpening properties on State Fair Blvd.:

Mr. John Connor, attorney for Terpening, was present to address the Board.  He said they are looking for a sewer connection for the Griffith Energy property on the corner of Farrell Road and State Fair Blvd.

 

Mr. Sykes said the interminucipal agreement between Van Buren and Town of Geddes and Van Buren and Terpening will allow for an outside user hookup to the sewer without the creation of a special district.

 

Mr. Connor asked that all protections that would be available under a district be included in the intermunicipal agreements.

 

Mr. Sykes said should Terpening fail to pay the Town of Geddes, Van Buren can put the amount owed on Terpening’s taxes and pay Town of Geddes.

 

Mr. Sykes said using the agreements to get the sewer connection will save time and money over the district creation.

Approval to engage AECC for professional services to conduct an EPA audit on the highway facilities at a cost of $2,500.00:

Approval to have PERMA carry the town’s workers compensation insurance effective July 1, 2011 – July 1, 2012 at a cost of $52,452:

Mr. Sykes said the town has NYSIF now for workers compensation insurance.  He said they completed an audit of the town’s payroll and our premium will likely increase about 35%.  He said PERMA deals exclusively with municipalities and will cover volunteers.

106-11-029     MOTION BY Ms. Dickman, seconded by Mr. Tupper, to approve the following resolution:

WHEREAS, The Supervisor of the Town of Van Buren desires to secure the Town of Van Buren’s obligation to provide workers compensation benefits through participation in a group self-insurance program if which the Town of Van Buren will be a member.

 

The Supervisor duly convened in regular session, does hereby resolve, pursuant to, and in accordance with the provisions of Section 50 of the New York State Workers Compensation Law and other applicable provisions of law and regulations thereunder, as follows:

Section 1. The Supervisor of the Town of Van Buren does hereby resolve to secure the Town of Van Buren’s obligation to provide workers compensation benefits through participation in a group self-insurance plan of which the Town of Van Buren will be a member.

 

Section 2. The Supervisor of the Town of Van Buren does hereby resolve to become a member of Public Employer Risk Management Association, Inc., a workers compensation group self-insurance program for local governments and other public employers and instrumentalities of the State of New York.

 

Section 3. In order to effect the Town of Van Buren’s membership in said group self-insurance program, the Supervisor of the Town of Van Buren is hereby authorized to execute and enter into the Public Employer Risk Management Association Workers’ Compensation Program Agreement.

 

Section 4. This resolution shall take effect immediately.

Ms. Sabin also thanked Mr. Parks for his many years of work.

 

Consider extended warranty for John Deere loader:

Mr. Sykes said the loader has been burning oil and the dealer has said they believe the machine has not been broken in yet.  Mr. Sykes said the town can purchase an extended warranty for the loader for either 24 months from the date of purchase for $2,241.53 or  36 months for $2,613.85.

 

Mr. Sykes said he would recommend the 36 month extension.

108-11-024     MOTION BY Ms. Sabin, seconded  by Mr. Shepard, to purchase the 36 month/3000 hours extended warranty for the John Deere loader in the amount of $2,613.85.

Councilor Committee Reports and Comments:

Mr. Tupper said he would like to set the public hearing for a local law at the next meeting that would prohibit curbside yard waste.  He said the town does not offer pickup and when homeowners do put yard waste out it creates stormwater management problems.

 

Ms. Dickman said the annual Lakeside Fire Department’s community day is July 17th from 1:00 pm to 3:00 pm at the State Fair Boulevard fire house.

 

Ms. Dickman wished Mr. Parks the best in his retirement.

 

Mr. Shepard reminded everyone that Margaritafest is July 9th from 3:00 pm to 6:00 pm and they have nine locations participating this year.  He said your stamped passport will allow free admission to the concert on Paper Mill Island that evening.

 

Mr. Shepard said the Greater Baldwinsville Economic Development Agency has been working on Alumni Weekend.  He said it is August 5th this year and more information on the events can be found at www.cwbakeraa.com.

Supervisor Comments:

Mr. Sykes said he received the following letter regarding the Erie Canal Trail:

 

I just want to thank any and all people involved in the prompt response to our request for the Memphis end of the canal trail brush removal.  It is not often you encounter as fine a gentleman as Ron Dudzinski, who personally responded to our inquiries about that canal area.

 

Ron has been instrumental from the very beginning to allow us the development of the Memorial Park (bench site) for our beloved son Bryan M. Place.  It is a project we hold very dear to our hearts and were it not for Ron’s great attitude and attention, it would not have happened.  He continues to be an ally in this project.  We thank him and anyone else who assists in this.  It is greatly appreciated.
